Welcome to Club Docket. These Terms of Service ("Terms") govern your access to and use of the Club Docket mobile and web applications and the website at www.clubdocket.com(collectively, the "Service"), provided by Club Docket LLC ("Club Docket," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.
2. Your Account
- You are responsible for maintaining the confidentiality of your account and credentials.
- You agree to provide accurate information and to update it as needed.
- You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.
3. User Content
"User Content" means anything you submit to the Service, including profile details, scorecards, rounds, posts, photos, messages, and comments. You retain ownership of your User Content. By submitting User Content, you grant Club Docket a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting), publicly display, and distribute it solely for the purpose of operating, providing, and improving the Service.
You represent and warrant that you own or have the necessary rights to submit your User Content.
4. Acceptable Use
You agree not to:
- Violate any applicable law, regulation, or third-party right.
- Post content that is unlawful, harassing, defamatory, hateful, sexually explicit, or that infringes intellectual property rights.
- Impersonate any person or entity or misrepresent your affiliation.
- Upload viruses, malware, or other harmful code, or attempt to disrupt the Service.
- Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure, or probe, scan, or test the vulnerability of any system or network.
- Use the Service to send spam, conduct surveillance, scrape data, or build a competing product without our written consent.
- Use the Service in any way that could harm minors.
5. Intellectual Property
The Service, including its software, design, logos, trademarks, and all content provided by Club Docket, is owned by or licensed to Club Docket and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms. No other rights are granted.
6. Third-Party Services
The Service may integrate with or link to third-party services (for example, Google or Apple sign-in, course data providers, payment processors, and analytics). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party content or practices.
7. Subscriptions and Purchases
Some features may require a paid subscription or one-time purchase. Pricing, billing cycles, and refund terms will be disclosed at the point of purchase. Subscriptions automatically renew unless cancelled before the renewal date through the platform where you purchased them (for example, the Apple App Store).
8. Termination
You may delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to the Service or other users. Sections that by their nature should survive termination will survive (including ownership, disclaimers, indemnification, and limitations of liability).
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. Club Docket does not guarantee the accuracy of course data, scoring information, GPS distances, or third-party content.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLUB DOCKET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CLUB DOCKET IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.
11. Indemnification
You agree to indemnify and hold harmless Club Docket and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. To the extent permitted by law, you and Club Docket waive the right to a jury trial and to participate in a class action.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
